The Broken Heat Pump

Since 2007 I have been providing home inspector training all over the country about legal issues that impact their practice and the tools and techniques that they can implement in their own businesses to reduce their likelihood of becoming victimized by their ungrateful clientele.

Since I began giving the seminar, I have also been asked by hundreds of home inspectors to respond to claims made by their clients and their clients’ attorneys. As of this writing, I am batting .970 at terminating those claims with prejudice.

I am not surprised by that statistic because the majority of home inspection claims have no merit. And by majority, I mean the overwhelming majority. In my personal experience, meritless claims represent about 99.999 percent of all claims against home inspectors. In other words, virtually all claims against home inspectors have absolutely no merit.

When Claimants Simply Make Allegations Up

Dear Joe – I am a Home Inspector of 5, very busy and successful years, here in [New England], despite the down housing economy.

I have just learned of you and have visited your website. I am very interested in learning more of your ClaimIntercept[™] Program.  Also I would like to know if your seminar titled “ Law & Disorder Seminar” is available as a DVD that I could purchase. I reside quite far away from the areas where you do any public speaking on a regular basis. I am a member of InterNACHI, and watch on their website for any further info about your Seminars maybe coming to [this] area.

Can you send me to any further information about ClaimIntercept?

My other reason for writing is that I am, for the first time, going to have a lawsuit filed against me for a “claimed omission” on a job, which is a false claim by a seller.  I do not feel I am responsible for the situation and that I did nothing wrong; it is the seller’s word against my word, basically. And that the seller is using this situation for his own gain, at my expense – to the tune of $15,000.

A Tale Of Two Inspectors

Last November I spoke at a home inspection conference on the Left Coast. As almost always happens, two inspectors who were in attendance at that conference subsequently had claims two-and-a-half months later. Both inspectors informed me when they notified me of the claim that they had been at the conference, enjoyed my presentation very much and had enrolled in the ClaimIntercept™ program.

One inspector had enrolled immediately after the conference, the other one waited until after he had a claim to enroll. The first inspector was thrilled that he could just forward the demand letter to me for response and forget about it.

The second inspector was shocked, shocked to learn that I was not going to allow him to take advantage of me.
